4. Account Registration

4.1 Account Creation

To use INSIEME, you must:

• Create an account with accurate and complete information
• Be at least 18 years old
• Maintain the security of your account credentials
• Subscribe to one of our membership tiers

4.2 Account Responsibility

You are responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your login information
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains current and accurate

5. Subscription & Payment Terms

INSIEME operates on a mandatory subscription model. All users must maintain an active subscription to use the platform.

5.1 Subscription Tiers

• PRO: €19.99/month - 50 free credits monthly
• PREMIUM: €99.99/month - 120 free credits monthly + 20% bonus on credit purchases
• A-LIST: €299.99/month - 300 free credits monthly + 50% bonus on credit purchases

5.2 Payment Processing

• All payments are processed through Apple In-App Purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Prices are subject to change with 30 days' notice
• Payment is charged to your Apple ID account at confirmation of purchase

5.3 Credit System

• Asking Questions: Costs 5 credits per question
• Reading Paid Replies: Costs 0.5 credits per reply
• Additional Credits: Can be purchased through in-app purchases
• Credit Expiration: Monthly free credits expire at the end of each billing cycle
• Purchased Credits: Do not expire as long as your subscription remains active

5.4 Refund Policy

• Subscription fees are non-refundable except as required by law
• Refund requests must be directed to Apple through the App Store
• INSIEME does not control Apple's refund policy
• Credits are non-refundable once purchased

5.5 Cancellation

• You may cancel your subscription anytime through your Apple ID settings
• Cancellation takes effect at the end of the current billing period
• You retain access to the App until the subscription period ends
• Unused credits are forfeited upon cancellation

6. User Conduct

6.1 Acceptable Use

You agree to use INSIEME in a professional, respectful manner. You will NOT:

• Post false, misleading, or fraudulent content
• Harass, threaten, or intimidate other users
• Impersonate any person or entity
• Post spam, advertisements, or unsolicited promotions
• Share content that is illegal, obscene, or offensive
• Violate any intellectual property rights
• Attempt to manipulate the credit system or payment features
• Use automated tools (bots) to access the App
• Share your account credentials with others

6.2 Professional Standards

If you provide professional advice, you agree to:

• Represent your qualifications accurately
• Provide advice within your area of expertise
• Comply with all applicable professional standards and regulations
• Not provide advice that could cause harm if followed

7. Content Ownership & License

7.1 Your Content

You retain ownership of content you post on INSIEME (questions, answers, comments, profile information). However, by posting content, you grant INSIEME a:

• Worldwide, non-exclusive, royalty-free license
• To use, reproduce, modify, display, and distribute your content
• For the purpose of operating and improving the App
• This license continues even if you delete your account (for content shared with other users)

7.2 INSIEME Content

All App content, features, functionality, and intellectual property (including logos, design, software) are owned by INSIEME and protected by copyright, trademark, and other laws.

7.3 Content Moderation

We reserve the right to:

• Remove or refuse to publish any content at our discretion
• Monitor user content for compliance with these Terms
• Take action against users who violate these Terms

8. Professional Earnings

8.1 Pay-to-Read Feature

Verified professionals can earn credits when users pay to read their answers. By participating, you agree that:

• INSIEME acts as a platform facilitating transactions between users
• You are responsible for any tax obligations on earnings
• Earnings are paid out according to our Payout Policy (available in-app)
• We may withhold or suspend payments if fraud or Terms violations are suspected

8.2 Verification Requirements

To earn from the platform, you must:

• Complete professional verification
• Maintain an active subscription
• Comply with all Terms and community guidelines
• Provide accurate tax and payout information when required

9. Privacy & Data

Your privacy is important to us. Please review our Privacy Policy which explains:

• What data we collect and why
• How we use and protect your information
• Your rights regarding your data
• How to contact us with privacy questions

By using INSIEME, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers & Limitations

10.1 No Warranty

INSIEME is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy, reliability, or quality of content
• Security from viruses or harmful components

10.2 Professional Advice Disclaimer

10.3 Limitation of Liability

To the maximum extent permitted by law, INSIEME and its affiliates shall NOT be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from user content or interactions with other users
• Damages resulting from reliance on advice obtained through the App

Maximum Liability: Our total liability shall not exceed the amount you paid to INSIEME in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless INSIEME, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you post on the platform
• Professional advice you provide to other users

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by:

• Going to Settings → Account → Delete Account in the App
• Contacting support at hello@insiemesocial.it

Account deletion is permanent and cannot be undone. All data will be deleted according to our Privacy Policy.

12.2 Termination by INSIEME

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent activity
• Your subscription payment fails and is not resolved
• We are required to do so by law
• We discontinue the App (with 30 days' notice)

Upon termination, you lose access to the App and any unused credits are forfeited.

13. Modifications to Terms

We may update these Terms from time to time. Changes will be:

• Posted in the App with an updated "Last Updated" date
• Notified to users via in-app notification for material changes
• Effective 30 days after posting (or immediately for legal/security reasons)

Continued use of INSIEME after changes constitutes acceptance of the new Terms. If you don't agree, you must stop using the App and cancel your subscription.

14. Intellectual Property

14.1 Trademarks

"INSIEME" and associated logos are trademarks of INSIEME. You may not use our trademarks without prior written permission.

14.2 Copyright

If you believe content on INSIEME infringes your copyright, contact us at hello@insiemesocial.it with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

15. Governing Law & Disputes

15.1 Governing Law

These Terms are governed by the laws of Italy, without regard to conflict of law principles.

15.2 Dispute Resolution

For disputes arising from these Terms or your use of INSIEME:

• Informal Resolution: Contact us first at hello@insiemesocial.it to resolve the issue
• Jurisdiction: If informal resolution fails, disputes shall be resolved in the courts of Parma, Italy
• EU Users: EU consumers retain rights under applicable consumer protection laws

15.3 Class Action Waiver

To the extent permitted by law, you agree to bring claims against INSIEME only in your individual capacity, not as part of a class action or collective proceeding.

16. Apple-Specific Terms

For users who download INSIEME from the Apple App Store, the following additional terms apply:

• Apple is not a party to these Terms and has no obligation with respect to the App
• Apple has no warranty obligation for the App
• Apple is not responsible for addressing claims related to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Upon acceptance of these Terms, Apple has the right to enforce them against you

17. Export Compliance

You agree not to export or re-export the App in violation of any export control laws and regulations of Italy, the European Union, or any other applicable jurisdiction.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published in the App, constitute the entire agreement between you and INSIEME regarding your use of the App.
